§ 1-2-6. Policy to defend county officers and employees in civil actions.

  • (a)

    Under the authority of sections 111.07, 111.071 and 111.072, F.S., it is hereby declared the policy of Charlotte County that it will, through the purchase of insurance or by providing private attorneys or attorney fees, defend every officer or employee, elected, appointed or employed, of the county who is named as defendant in any civil action, state or federal, for acts or omissions arising from the scope of their employment and will pay any final judgment including damages, costs and attorney fees.

    (b)

    No person shall be entitled to the benefit of this section if the county administrator shall recommend and the board shall find that the officer or employee charged in any legal action has acted outside the scope of his employment or in bad faith, or with malicious purpose, or in a manner exhibiting wanton and willful disregard of human rights, safety or property.
