§ 2-3-23. Inspection.

  • The health department shall inspect all food service establishments, food outlets, food processing plants, shellfish establishments and abattoir houses within the county and, if a violation of any provision of this article is determined to exist, the director shall give the operator of such facility a reasonable time following the receipt of written notice thereof within which to correct such violations. During this specified period of time, the operator, who may be accompanied by his attorney and/or persons of his choice, shall be entitled to a review hearing by and at the convenience of the director in the presence of the involved health department employee and the employee's supervisor. The director may, at his discretion, withdraw the official notice, alter the time limit for correction of violations or direct that the official notice shall remain in effect as written. Should the director not change the official notice and should the violation or violations continue beyond the time specified for correction by the official notice, the facility permit shall be revoked by the director. Notice shall be given by delivery or by certified or registered mail addressed to the management of such facility at the street address of such facility. Revocation by the health department shall suspend the right of the operator of such facility to operate such facility until a new health department permit is obtained.
