§ 2-3-24. Emergency closings.

  • If, in the opinion of the director based upon competent substantial evidence, conditions of a food service establishment, food outlet, food processing plant, shellfish establishment or abattoir house represent a clear and present danger of an immediate threat to the life or health of the patrons or employees and the operator of such facility refuses cooperation with the health department in taking whatever actions are deemed reasonable and necessary by the health department, the facility shall be ordered closed by the director. The facility shall remain closed until, in the opinion of the director, the dangerous condition has been removed and the facility fully complies with all of the provisions of this article.
