§ 1-4-40. Penalties.

  • (a)

    The county has adopted a schedule of fees for violations of chapter 1-4, article II, of the Code of Laws and Ordinances of Charlotte County, Florida. These fees relate solely to the matters covered by this article and are separate from all other fees chargeable by the county. Fees may be adopted and/or amended by resolution of the board of county commissioners.

    (b)

    A violation of this article is a civil infraction.

    (c)

    The maximum civil penalty for a civil infraction shall not exceed five hundred dollars ($500.00).

    (d)

    The civil penalty for a civil infraction shall be less than the maximum civil penalty, if the person who has committed the civil infraction does not contest the citation.

    (e)

    Civil penalties for civil infractions are set forth in Schedule A below.

    (2)

    Pursuant to F.S. § 828.27, in addition to any civil penalties imposed under this chapter, a surcharge of five dollars ($5.00) shall also be imposed with each civil penalty. The proceeds of such surcharge shall be used to pay the costs of training for animal control officers.

    (3)

    The clerk shall collect an administrative filing fee of ten dollars ($10.00) for each citation from the board of county commissioners. This administrative fee shall be included in addition to civil fine.
