§ 2-5-8. Prohibited acts in the Rotonda West subdivision.

  • (a)

    Purpose; prohibited acts. The purpose of this section is to supplement existing federal, state and local laws to fully provide that it shall be unlawful for any person to engage in any of the following activities on or upon the publicly dedicated walks, alleys, thoroughfares, parks and other open spaces, canals, drainage easements or other publicly dedicated easements shown on plats of the sections of the subdivision of Rotonda West known as:

    Rotonda Pinehurst as shown in the plats thereof, recorded in Plat Book Number 8 at pages 12A through 12K and Rotonda Pebble Beach as shown in the plats thereof, recorded in Plat Book Number 8, pages 13A through 13L in the Public Records of Charlotte County, Florida and the sections of Rotonda West known as: Rotonda Broadmoor; Rotonda Long Meadow; Rotonda White Marsh; Rotonda Pine Valley; Rotonda St. Andrews; Rotonda Oakland Hills; as shown in the plats thereof, recorded in Plat Book 8, pages 15A through 19K, and pages 21A through 21L and Plat Book 10, page 3, in the Public Records and Charlotte County, Florida, and the sections of Rotonda known as: Rotonda Heights as shown in the plats thereof, recorded in Plat Book Number 8, pages 26A through 26Z, inclusive; Rotonda Lakes I, recorded in Plat Book Number 8, pages 22A through 22-Z-3 inclusive; Rotonda Lakes II, recorded in Plat Book Number 8, pages 25A through 25G, inclusive; Rotonda Meadows, recorded in Plat Book 10, pages 15A through 15-Z-18, inclusive; Rotonda Sands, recorded in Plat Book Number 9, pages 2A through 2-Z-49, inclusive; Rotonda Shores, recorded in Plat Book Number 10, pages 7A through 7N, inclusive; Rotonda Springs, recorded in Plat Book Number 12, pages 5A through 5-Z-70, inclusive; Rotonda Villas, recorded in Plat Book Number 12, pages 1A through 1-Z-15, inclusive; Rotonda Sands North, Replat Unit 1, recorded in Plat Book Number 11, pages 4A through 4-Z-2, inclusive; Rotonda Sands North Commercial Lots (Block 12, Lots over 30 and Block 15), recorded in Plat Book Number 15, pages 60A and 60B; Rotunda Sands South, Replat Unit 2, recorded in Plat Book Number 11, pages 5A through 5-Z-13, inclusive; Windward, as recorded in Plat Book Number 15, pages 59A through 59-0; Cape Haze East, as recorded in Plat Book Number 3, page 10 and 1st addition, Book Number 3, page 28, and 2nd Addition, Book Number 3, page 54; Cape Haze, as recorded in Plat Book Number 2, page 93 and Block R as recorded in Plat Book Number 3, page 42 and Block U, as recorded in Plat Book Number 4, page 46, in the Public Records of Charlotte County, Florida.

    (1)

    Camp or to otherwise set up tents, shacks or any temporary shelter for the purpose of such camping.

    (2)

    Build, attempt to build, set or maintain a fire.

    (3)

    Operate or park a motor vehicle except on the roads or thoroughfares intended for such operation or parking.

    (4)

    Litter, which means the discarding of glass, paper, boxes, cans, dirt, rubbish, waste, garbage, yard debris or other forms of refuse.

    (5)

    Operate a motorboat so as to create a hazardous wake or wash, or in a dangerous or reckless manner so as to endanger the safety of any person or any person's property.

    (6)

    Operate off-road all terrain vehicles (ATV), or dirt bikes, except those licensed for road use while being used on roads or thoroughfares intended for such operation.

    (7)

    Nothing in the above subsections (1) through (7) is intended to prohibit a property owner from the lawful use and enjoyment of his own property, subject to deed restrictions.

    (b)

    Posting of signs. The board of county commissioners is hereby empowered to post signs for the enforcement of this regulation.
