§ 2-4-77. Parking in spaces for handicapped.

  • (a)

    There is hereby imposed, pursuant to F.S. section 316.008(4), a one hundred dollar ($100.00) fine for violation of the provisions of F.S. sections 316.1955(5) and 316.1956(3).

    (b)

    The fine imposed pursuant to subsection (a) shall be in lieu of any penalty imposed pursuant to F.S. section 318.18(2).

    (c)

    Any law enforcement officer or parking enforcement specialist as defined by Florida Statutes shall enforce the provisions of this section.

    (d)

    This section shall not affect the provisions of subsection (5)(a) of F.S. § 316.1955, which provides for the removal of the vehicle in violation.

    (e)

    Pursuant to the requirements of F.S. § 316.1967, the clerk of the court shall periodically supply the Florida Department of Motor Vehicles with a magnetically encoded computer tape reel or cartridge which is machine readable by the installed computer system at the Florida Department of Motor Vehicles listing persons who have any outstanding violations of F.S. § 316.1955, which provides for parking violations involving handicapped parking spaces provided by a governmental agency for public parking; F.S. § 316.1956, which provides for parking violations involving parking spaces provided for the handicapped by a nongovernmental entity, and this section 2-4-77 which provides that it shall be a violation of this Code for the nonhandicapped to park in spaces reserved for the handicapped.
