§ 1-10-144. Enforcement of article.

  • (a)

    Whoever violates sections 1-10-135 through 1-10-140 of this article may be prosecuted and punished as provided by F.S. section 125.69. Nothing in this requirement shall be interpreted to bind sheriff's deputies to the requirements of code inspectors under section 125.69, Florida Statutes.

    (b)

    In addition to the penalties provided for violation of county ordinances in Charlotte County Code section 1-1-8, sexually oriented businesses not in conformity with the requirements of this article shall be subject to the appropriate civil action, including injunctive relief, in the court of appropriate jurisdiction for their abatement. Each day that any violation is committed shall constitute a separate offense.

    (c)

    It is the responsibility of the licensee, owner, employee or operator of a sexually oriented business to ensure compliance with this article, notwithstanding the issuance of a local business tax receipt, building permit, zoning clearance for an alcohol license, or any other governmental permit.
