§ 1-10-135. Prohibited acts.

  • (a)

    It shall be a violation of this article for any person to act as an employee of a sexually oriented business that he knows or should know is required to be licensed under this article but is not so licensed, or which has a license which is under suspension, has been revoked or canceled, or has expired.

    (b)

    It shall be a violation of this article for any person to alter or otherwise change the contents of a sexually oriented business license or occupational license without the written permission of the community development department.

    (c)

    It shall be a violation of this article for any business entity or licensee to operate or for any person to be an operator or employee of a sexually oriented business and to knowingly, or with reason to know, permit, suffer, or allow the entrance or exit of the sexually oriented business to be locked when a person other than an employee is inside the establishment.

    (d)

    It shall be a violation of this article to transfer a sexually oriented business license or the control, operation or management of a sexually oriented business without satisfying all of the provisions of section 1-10-129 of this article.

    (e)

    It shall be a violation of this article for an operator of a sexually oriented business, regardless of whether it is licensed under this article, to advertise the presentation of any activity prohibited by any applicable state statute or local code or ordinance.

    (f)

    It shall be a violation of this article to be an operator of a sexually oriented business, regardless of whether it is licensed under this article, at which the records for employees required by section 1-10-133 of this article have not been compiled, are not maintained or are not available for inspection.

    (g)

    It shall be a violation of this article for any person applying for a sexually oriented business license to make a false statement which is intended to facilitate the issuance of a license, or to provide false information which is intended to facilitate the issuance of a license.
