§ 1-10-137. Hours of operation.

(a)

It shall be a violation of this article for any operator of a sexually oriented business to allow such sexually oriented business to remain open for business, or to permit any employee to engage in a performance, solicit a performance, make a sale, solicit a sale, provide a service, or solicit a service between the hours of 2:00 a.m. and 8:00 a.m. of any particular day.

(b)

It shall be a violation of this article for any employee of a sexually oriented business to engage in a performance, solicit a performance, make a sale, solicit a sale, provide a service, or solicit a service between the hours of 2:00 a.m. and 8:00 a.m. of any particular day.

(c)

The provisions of subsections (a) and (b) of this section apply regardless of whether employees are no longer participating in the sale or rental of adult material, the display of specified anatomical areas, or are engaged in specified sexual activities after 2:00 a.m. A sexually oriented business, licensed or permitted as such, will be considered a sexually oriented business at all times and is subject to all provisions of this article until such time as the sexually oriented business license or permit is suspended, canceled, revoked or voluntarily terminated.
