§ 1-10-129. Transfer of ownership, operation or control.

  • (a)

    Requirements for transfer. Neither a licensee under this article, nor an operator operating a sexually oriented business pursuant to section 1-10-125 of this article, shall transfer his license or the control, operation or management of the sexually oriented business to another business entity or person, and thereby surrender ownership, possession, control, or operation of the licensed sexually oriented business to such other business entity or person, unless and until such other business entity or person satisfies the following requirements:

    (1)

    Obtains a new license from the community development department, in the name of the new licensee, which new license may be obtained only upon completion and proper filing of an application with the community development department setting forth the information called for in section 1-10-122(b)(1) through (14) of this article, with respect to the new applicant; and

    (2)

    Pays the application fee and the appropriate annual license fee.

    (b)

    Effect of suspension or revocation procedures. No license may be transferred pursuant to subsection (a) of this section when the community development department has notified the licensee that suspension or revocation proceedings have been or will be brought against the licensee.

    (c)

    No transfer to different location. A licensee shall not transfer his license under this article to another location.
