§ 4-4-36. Automatic implementation of rate change.

  • Notwithstanding any other provisions of this article, if a final order has not been adopted by the governing body within eight (8) months of the official date of filing an application for rate change, or within sixty (60) days of receipt of the notice of index adjustment, the requested rates may be put into effect by the party seeking the rate adjustment subject to the posting of a good and sufficient bond or corporate undertaking, and subject to refund of any unauthorized revenue, plus interest at a rate to be determined by the governing body upon adoption of a final order by the governing body. In the event no final order has been adopted by the governing body within twelve (12) months of the official filing date, the requested rates shall become final and the posted bond or corporate undertaking shall no longer be required.
