§ 4-4-33. Rates.

  • (a)

    The governing body shall approve rates for franchisees for each customer class which are just, reasonable, compensatory, and not unfairly discriminatory.

    (b)

    Before approving rates, the governing body shall consider the value and quality of service. A quality of service hearing shall be conducted as part of the public hearing to consider adjustments of rates, fees and charges. As part of the quality of service hearing, the governing body shall consider the franchisee's compliance with county ordinances and state law, and all other matters affecting the public welfare.

    (c)

    The governing body shall approve rates by employing an operating ratio approach.

    (d)

    This section shall not apply to rates established by application of the indexing procedures provided in this article.
