§ 4-4-32. Filing requirements for adjustment of rates, fees and charges.

  • (a)

    Except as otherwise provided in this article, when a public hearing is convened by the governing body or upon application of the franchisee to consider adjustments or rates, fees and charges, the franchisee shall submit to the county environmental and extension services department, as a minimum filing requirement, the following information when applicable:

    (1)

    Schedule of present and proposed rates, fees and charges with a calculation of the revenue produced at each rate, fee and charge in accordance with the franchisee's prepared cost of service study;

    (2)

    Detailed cost of service study by class of customer for each proposed rate, fee and charge;

    (3)

    Schedule of the number of customers by month and by rate classification for the twelve-month test period;

    (4)

    Schedule of revenue by month and by rate classification for the twelve-month test period;

    (5)

    Detailed support for any projections in customer growth anticipated during the year that rates, fees and charges will be in effect;

    (6)

    Schedule of expenses by rate class, by major category, and by month for the twelve-month test year;

    (7)

    Schedule of expenses by rate class, by major category, and by each year since the last public hearing adjusting rates, fees and charges. Said schedule shall show the percentage change by expense category, by year. Said schedule shall also provide a detailed explanation of any percentage change in excess of the index factor in effect for any given year. Such explanation shall be comprehensive and show any calculations necessary to support the same;

    (8)

    Schedule of additions, retirements and transfers by year of any property, plant and equipment since the last public hearing adjusting rates, fees and charges.

    (9)

    Constructed statement of operations for residential, commercial and roll-off operations separately detailing all pro forma adjustments being requested and detailed explanations and calculations in support of each adjustment;

    (10)

    A copy of the franchisee's complaint log for the preceding twenty-four (24) months.

    (b)

    The official date of filing for the purposes of this article is the date on which the franchisee has filed fifteen (15) complete sets of the minimum filing requirements provided in this section.
