§ 4-3-161. Creation of district, description of boundaries.

  • (a)

    Generally. Upon the effective date of this act [this article], all of the lands in Sarasota and Charlotte Counties, Florida, hereinafter described, shall become and be incorporated into and as a special fire control district, which shall become and be a public municipal corporation, herein set forth under the name of [the] Englewood Area Fire Control District. The lands so to be incorporated being described as follows:

    FIRE DISTRICT
    SARASOTA COUNTY LEGAL DESCRIPTION

    Begin at the intersection of mean high water line of the Gulf of Mexico on the west shore of Manasota Key with the north line of Section 5, Township 40 South, Range 19 East, Sarasota county, Florida; thence easterly across Manasota Key to the mean high water line of Lemon Bay; thence southeasterly along the waters of Lemon Bay to the intersection with the northerly right-of-way line of the Manasota Beach Road; thence northeasterly and easterly along said northerly right-of-way line to the west line of Section 10, Township 40 South, Range 19 East; thence north along said west line of Section 10, Township 40 South, Range 19 East to the northwest corner of said section; thence easterly along the north line of Sections 10, 11 and 12, Township 40 South, Range 19 East, and continue easterly along the north line of Sections 7, 8, 9 and 10, Township 40 South, Range 20 East to the centerline of South River Road; thence southerly and southwesterly along said centerline to the south line of Section 15, Township 40 South, Range 20 East and the municipal boundary of the City of North Port; thence west along the south line of said Section 15 (also the North Port boundary) to the southwest corner thereof; thence south along the east line of Sections 21 and 28, Township 40 South, Range 20 East (also the North Port boundary) to the southeast corner of said Section 28; thence west along the south line of said Section 28 (also the North Port boundary) to the northeast corner of the northwest one-fourth of Section 33, Township 40 South, Range 20 East; thence south along the east line of the west one-half of said Section 33 (also the North Port boundary) to the south line of said Section 33; thence west along the south line of Sections 33, 32 and 31, Township 40 South, Range 20 East and continue west along the south line of Sections 36 and 35, Township 40 South, Range 19 East, this line being the Sarasota-Charlotte County line, to the intersection with the mean high water line of the Gulf of Mexico at the west shoreline of Manasota Key; thence northerly and westerly along the mean high water line of the Gulf of Mexico to the intersection with the north line of Section 5, Township 40 South, Range 19 East, and the point of beginning.

    FIRE DISTRICT
    CHARLOTTE COUNTY LEGAL DESCRIPTION

    Beginning at the intersection of the Gulf of Mexico with the north line of Section 2, Township 41 South, Range 19 East, Charlotte County, Florida; run easterly along the north line of said Township to the northeast corner of Section 1, Township 41 South, Range 20 East; thence southerly along the east line of said Range 20 East, to the northwest corner of Section 6, Township 42 South, Range 21 East; thence easterly along the north line of said Township 42 to the westerly shore of Charlotte Harbor; thence southerly and westerly along Charlotte Harbor to Cape Haze; thence northwesterly to an intersection of the westerly shore of Turtle Bay with the northerly shore of Cape Haze-Gasparilla South; thence westerly and northwesterly along shores of Cape Haze-Gasparilla South, Placida Harbor and Lemon Bay to a point East of Stump Pass; thence westerly through Stump Pass to an intersection of the northerly shore of Stump Pass with the easterly shore of the Gulf of Mexico; thence northwesterly along said shore to the point of beginning.

    (b)

    Purposes and general powers. The purpose of this act [this article] is to promote the health, welfare, and safety of the citizens and residents of Sarasota and Charlotte Counties, who reside within the geographical limits of that area known as the Englewood Area Fire Control District, by providing for: The establishment and maintenance of fire stations and fire substations; the acquisition and maintenance of all fire fighting and protection equipment necessary for the prevention of fire or fighting of fires; the employment and training of such personnel as may be necessary to accomplish fire prevention and fire fighting; the establishment and maintenance of emergency service; the acquisition and maintenance of rescue and other emergency equipment; and the employment and training of necessary emergency personnel. The district shall have all other powers necessary to carry out the purposes of the district as otherwise provided by law, including, but not limited to, the power to adopt all necessary measures, rules, and regulations and policies relating to said purposes.

    (c)

    Services provided. The district shall be a fire control district and shall have no responsibility for providing ambulance or similar emergency services within the district's boundaries. It is the purpose of this act [this article] to provide for fire and rescue services only, and to exclude ambulance and similar services.
