(a)

HLP I, LLC, a Florida limited liability company, submitted a petition to the Charlotte County Board of County Commissioners (the "board") pursuant to F.S. Ch. 190 to establish the Heritage Lake Park Community Development District ("CDD").

(b)

On June 22, 2004, the board held a public hearing on the petition.

(c)

Notice of the public hearing, containing the time and place for the hearing, describing the area to be included in the CDD, including a map showing the area to be covered by the CDD, was timely given.
