§ 2-5-135. Exemptions.

  • The following uses and activities shall be exempt from this article:

    (1)

    Air conditioners and lawn mowers when functioning in accord with the manufacturer's specifications and with all manufacturer's mufflers and noise reducing equipment in use and in proper operating condition.

    (2)

    Nonamplified crown noises resulting from otherwise lawful public gatherings.

    (3)

    Use of loudspeakers for announcing public outdoor athletic events, such as, but not limited to, high school football games, from designated stadiums or ball fields.

    (4)

    The operation of any construction or demolition equipment in compliance with section 3-2-73 of this Code. No time limit shall be imposed when the construction involves a public project for which government permits allow construction at all hours.

    (5)

    Noise of safety signals, warning devices and emergency pressure relief valves.

    (6)

    Noises resulting from any authorized emergency vehicle when responding to an emergency call or acting in time of emergency.

    (7)

    Any aircraft operating in conformity with, or pursuant to, federal law, federal air regulations and air traffic control instructions used pursuant to and within the duly adopted federal air regulations.

    (8)

    The normal operations of railroad trains.

    (9)

    Motor vehicles operating within public and private streets when functioning with all manufacturer's mufflers and noise reducing equipment in use and in proper operating condition.

    (10)

    Noises resulting from emergency work.

    (11)

    Animal noises from offices of veterinarians or animal shelters located in appropriate zoning districts, for which all necessary permits therefor have been obtained.

    (12)

    Public fireworks displays when the promotor thereof has obtained required government permits for such display.

    (13)

    Any sounds resulting from the use of bells, carillons, or similar devices at a place of public worship.
