§ 2-4-80. Waiver of parking regulations for special events.

  • (a)

    Procedure established. There is hereby established a procedure for the board of county commissioners to temporarily waive provisions of specified parking ordinances to accommodate special events.

    (b)

    Applicability. The provisions of this article shall apply to all Code provisions and ordinances which prohibit parking in portions of the unincorporated area of Charlotte County, including, but not limited to, the following:

    Sections 1-11-9 and 2-5-7 of this Code; and Ordinances 79-37, 80-05, 80-16, 80-19, 81-06, 82-12, 82-16, 82-21, 82-28, 83-20, 84-07, and 85-22.

    (c)

    Finding of public interest. In order for the board to temporarily waive provisions of specified parking ordinances to accommodate special events, the board shall, by majority vote, find that such waiver is in the best interest of the public.

    (d)

    Resolution; limitations as to manner, duration and extent of such waiver and the location affected thereby. The board's decision to grant such a waiver shall be evidenced by resolution. The resolution shall contain specific limitations as to the manner, duration and extent of such waiver and shall specifically delineate the location affected thereby. The resolution shall designate the ordinance(s) or Code section(s) being waived.

    (e)

    Notification. The clerk to the board shall timely provide the sheriff's office with a copy of the signed resolution.
