§ 2-4-2. Trucks on access roads.

  • (a)

    For the purposes of this section the following words shall have the following meanings:

    Access roads: North Tamiami Drive from Port Charlotte Boulevard south to its intersection with Westchester Boulevard, and South Tamiami Drive from West Tarpon Drive south to Lister Street, and the adjacent dedicated park strips lying between said North and South Tamiami Drives, respectively, and U.S. 41 (State Road 45), all as dedicated and delineated by the plats of Port Charlotte Subdivision, Sections, 1, 2, 3, 7, 9, 11, 18, 25 and 45, and Plaza 1 and Plaza 2, recorded in Plat Book 3 at pages 26, 30 and 35; Plat Book 4 at pages 11, 19 and 22; Plat Book 5 at pages 8A through 8E, 18 and 56; and Plat Book 7 at pages 63 and 67, all of public records of the county.

    Truck: Any motor vehicle designed, used or maintained primarily for the transportation of property, having more than (2) wheels on the rear axle thereof. As used herein, "truck" shall include the terms "truck-tractor" and "semi-trailer" as those terms are defined in F.S. Ch. 316.

    Truck parking: The halting of a truck, whether occupied or not, except when necessary to avoid conflict with other traffic or to comply with the directions of a law enforcement officer or traffic-control sign or signal, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise.

    (b)

    It shall be unlawful for any person to propel move or operate any truck on the access roads except for vehicles operating along the access roads as the shortest route between U.S. 41 (State Road 45) and a destination where the truck will be loaded or unloaded.

    (c)

    Truck parking on the access roads, including the adjacent dedicated park strips, shall be a violation of this Code.

    (d)

    The department of public works is directed to post at the intersection of the access road, with all roads providing access therefrom to U.S. 41 (State Road 45), appropriate signs saying "No through trucks—No truck parking."
