§ 2-3-32. Unsafe food and drink.

  • Food and drink products may be examined or sampled for laboratory examination by the health department as often as may be necessary to determine freedom from unwholesomeness, adulteration or any unsafe condition including misbranding or mislabeling, in any way likely to injure the public health. The director is authorized to collect and hold in proper storage such samples of food and drink products as may be necessary for evidence. It shall be the duty of the director to condemn and destroy or otherwise render inedible all such food and drink sold, offered for sale or stored by a food service establishment, food outlet, food processing plant, shellfish establishment or abattoir house. It shall be a violation of this Code for any facility to sell or continue to offer for sale any such food or drink.
