§ 2-1-55. Enforcement.

  • Any health care facility as defined by F.S. ch. 252 and Rule 27P-20.002 (2) of the Florida Administrative Code, not abiding by the provisions set out in this division shall be subject to punishment for violating a Charlotte County Ordinance. To enforce this division the Charlotte County Emergency Management Office has the authority to bring any violator to the Charlotte County Code Enforcement Board. In addition, the Charlotte County Board of County Commissioners may enforce this division by any other means provided by law and may further enforce this division by actions at law and in equity, including actions for injunctive relief. If the county prevails in any such action, the county shall be entitled to its costs and reasonable attorney's fees incurred in such action.

    Subsequent action will also include notifying the Agency for Health Care Administration of the facility violation, with possible monetary fines and loss of operating license.
