§ 1-10-438. Refrigerant removal and verification.

(1)

The standards for evacuation of refrigerant to recovery or recycling machine in 40 C.F.R. Part 82, and as may be amended from time to time, are hereby incorporated into this section by general reference. All references to 40 C.F.R. Part 82 in this section shall be as a general reference and incorporate the regulations contained therein as may be amended from time to time.

(2)

Secondary metals recycler shall, before any item is buried, shredded, dismantled, sold or otherwise disposed, recover any remaining refrigerant from the appliance in accordance with 40 C.F.R. Part 82.

(3)

Any documented violations of 40 C.F.R. Part 82 shall be forwarded to the United States Environmental Protection Agency for enforcement.
