§ 1-10-172. Exemption from this article for certain franchised cable operators.

  • (a)

    Franchised cable operators who are exempted from complying with the provisions of this article are as follows:

    (1)

    A franchised cable operator who is exempted from this article as a result of federal or state law;

    (2)

    A franchised cable operator who is exempted from this article as a result of an applicable FCC ruling; or

    (3)

    A franchised cable operator who is exempted from this article as a result of an applicable judicial ruling, from which all subsequent appeals have been exhausted or concluded.

    (b)

    It is expressly understood that an exempted franchised cable operator remains exempted only as long as it meets one (1) or more of the criteria of this particular section.

    (c)

    An exempted franchised cable operator is exempted only from this article. Consequently, such an exempted franchised cable operator shall abide by and comply with any other applicable county, state, or federal laws and regulations, including any applicable federal or state consumer protection or customer service laws and regulations.
