§ 1-10-123. Investigation of application.

  • (a)

    Upon receipt of an application for a license under this article properly filed with the community development department and upon payment of the nonrefundable application fee, the community development department shall immediately stamp the application as received and shall immediately thereafter send photocopies of the application to the office of the sheriff and to other reviewing departments.

    (b)

    Upon request of the board of county commissioners made through the community development department, the office of the sheriff shall, within thirty (30) days of said request, complete the requested investigation. At the conclusion of its investigation, the office of the sheriff shall indicate, on the photocopy of the application, the results of the investigation and shall deliver same to the community development department within said thirty-day period. The results of the investigation shall include a recommendation of approval or denial and, if denial is recommended, shall indicate the specific reasons for denial, including the names of any individuals having been convicted of specified criminal acts within the time frame of section (c) of this section, the specified criminal act(s), and the date of conviction of each.

    (c)

    If any violation of any provision of the Charlotte County Code, any statute, ordinance or regulation is found, the respective department shall, within the thirty-day period described in paragraph (b) above, notify the community development department by making a notation on the application which describes such violation and shall offer suggestions for correction.

    (d)

    The community development department shall notify the applicant of the results of the investigation not earlier than thirty (30) days following receipt of the application in order to wait for the response from the sheriff and the other reviewing departments. All communications regarding approval or denial shall be issued by the community development department. Oral statements issued directly or independently by the reviewing agencies shall not be deemed to create a reliance or estoppel situation as to the provisions of the Charlotte County Code.
