§ 1-10-117. Responsibilities of board of commissioners, community development department, other departments, and sheriff.

  • (a)

    Ultimate responsibility for the administration and enforcement of this article is vested in the board of county commissioners.

    (b)

    The community development department is responsible for granting, denying, revoking, renewing, suspending, and canceling sexually oriented business licenses for proposed or existing sexually oriented businesses and for ascertaining whether a suspected sexually oriented business is licensed. The community development department is responsible for verifying information contained on an application pursuant to section 1-10-122(b) of this article. The health department and the office of the sheriff shall, upon request, assist the community development department in its investigative responsibilities.

    (c)

    The community development department and the office of the sheriff are responsible for inspecting any proposed, licensed or nonlicensed sexually oriented business in order to ascertain whether it is in compliance with applicable local ordinances and criminal statutes, including the provisions set forth in sections 1-10-136 through 1-10-140 of this article. The office of the sheriff is responsible for all enforcement actions brought under sections 1-10-136 through 1-10-140 of this article.

    (d)

    The community development department is responsible for ascertaining whether a proposed sexually oriented business for which a license is being applied for complies with all location requirements of county ordinances.

    (e)

    Any law enforcement officer or employee of the departments referenced in subsections (b) and (c) of this section who is authorized by the head of that department shall, at any reasonable hour, have access to and shall have the right to inspect the premises of all sexually oriented businesses, whether or not licensed under this article, for compliance with any or all of the applicable codes, statutes, ordinances, and regulations in effect in the county and within the responsibilities of his respective department as outlined in subsections (b) and (c) of this section. Such officer or employee shall require strict compliance with the provisions of this article. Reports of violations shall be reported to the community development department.
